Remote verification, explained.
Since August 1, 2023, qualified employers can examine Form I-9 documents over live video instead of in person. Here is how it works and who can use it.
The official guidance is at USCIS I-9 Central.
What is Form I-9?
Form I-9, Employment Eligibility Verification, records that the identity and employment authorization of each person hired in the United States has been verified. It applies to citizens and noncitizens alike. The employee completes Section 1, and the employer or an authorized representative completes Section 2. The form is issued by U.S. Citizenship and Immigration Services (USCIS).
What is the alternative procedure?
It is a USCIS-authorized substitute for physically examining documents. Within three business days of the employee's first day of employment, the employer or its representative:
- reviews copies of the employee's documents, front and back if two-sided;
- holds a live video interaction in which the employee presents the same documents;
- confirms the documents reasonably appear to be genuine and to relate to the employee;
- keeps a clear copy of the documents; and
- checks the alternative procedure box on Form I-9.
Who can use it?
Only employers enrolled in E-Verify and in good standing, at each hiring site where the procedure is used. An employer must apply it consistently at a site, either to all employees there or to all remote employees there. Employers that do not participate in E-Verify must examine documents physically.
How does remote document examination work?
The employee first sends copies of their documents to the employer. The employer or its representative then holds a live video interaction with the employee and examines the same documents, front and back if two-sided.
