Where Form I-9 gets hard.
If your hiring includes any of these, AYIN Form I-9℠ is built for it.
A three-day clock
Section 2 is due within three business days of an employee's first day of employment. The hard part is knowing which combinations of documents are acceptable, because errors are counted form by form in an inspection by U.S. Immigration and Customs Enforcement (ICE).
Documents at a distance
Remote work raised the stakes on document examination. Examining documents remotely is permitted only under the alternative procedure, which requires E-Verify enrollment in good standing.
Deadlines that come back
Expiring employment authorization and rehires bring their own timelines. Both are recorded in Supplement B of Form I-9, formerly Section 3.
What Form I-9 errors cost.
ICE inspects Forms I-9 and assesses civil penalties per form and per worker. These are the amounts set by the Department of Homeland Security (DHS) inflation adjustment effective January 2, 2025, in force as of October 2026.
| Violation | Minimum | Maximum | Assessed |
|---|---|---|---|
| Form I-9 paperwork violation | $288 | $2,861 | Per form |
| Knowingly hiring or continuing to employ an unauthorized worker, first offense | $716 | $5,724 | Per worker |
| Knowingly hiring or continuing to employ an unauthorized worker, second offense | $5,724 | $14,308 | Per worker |
| Knowingly hiring or continuing to employ an unauthorized worker, third or later offense | $8,586 | $28,619 | Per worker |
| E-Verify employer failing to notify DHS of continued employment after a final nonconfirmation | $998 | $1,992 | Per employee |
